This Privacy Policy is part of the Swaply Terms of Service. All terms, conditions, and terminology are consistent with the Terms of Service, which are incorporated into this document by reference.
This policy governs the use of the Swaply website at swaply-labs.xyz, the Swaply mobile applications, and the associated tools and services (collectively, the “Services”).
Swaply Labs operates the Services. It and its affiliates are referred to in this document as the “operator,” “we,” or “us.”
The Blockchain
Blockchain technology is at the core of the Services. Blockchains are decentralized and made up of digitally recorded data in a chain of blocks. Because the ledger may be distributed across many nodes worldwide, there is no single person administering the system and no centralized place where it is located.
By design, a blockchain’s records cannot be changed or deleted and are said to be “immutable.” This may affect your ability to exercise rights such as your right to erasure (“right to be forgotten”) or your rights to object to or restrict processing of your personal data. Data on the blockchain cannot be erased or changed.
In order to deliver the Services, it may be necessary to write certain data, such as your wallet address, onto the blockchain; this requires you to execute such transactions using your wallet’s private key. The ultimate decision to transact on the blockchain using your wallet address rests with you. If you want to ensure your privacy rights are not affected, you should not transact on blockchains, as certain rights may not be fully available due to the technological infrastructure of the blockchain. The blockchain is public, and any personal data shared on the blockchain will become publicly available.
Individuals Under the Age of 18
As per our Terms of Service, individuals under the age of 18 are not permitted to use the Services. We do not knowingly collect, solicit, or maintain personal data from anyone under the age of 18. If we learn that we have collected personal data from an individual under 18, we will use commercially reasonable efforts to delete that information from our database. Note that we cannot delete information stored on public blockchains.
What We Collect
We collect information you provide and information generated through your use of the Services. This may include:
- Information you provide. Content and communications you provide when you use the Services, including when you contact support or submit feedback. Depending on the features you use, this may include your email address or other contact details.
- On-ramp / verification information. If you use a third-party on-ramp to fund your wallet, that provider may require identity or payment information. That information is collected and processed by the provider under its own policies; we receive only the limited information necessary to facilitate the Services.
- Usage information. Information about how you use the Services, such as the features you use, the actions you take, and the time, frequency, and duration of your activities.
- On-chain information. Wallet (externally owned account) addresses, transactions made, transaction hashes, and token balances.
- Device and network information. Device identifiers, operating system, app version, language, time zone, IP address, and information necessary to enable push notifications if you enable them.
Cookies & Similar Technologies
We, and our partners, may use cookies and similar technologies to remember you and to understand how you interact with the Services. You may have the option to accept or refuse these cookies. If you refuse, you may not be able to use some portions of the Services.
Where Data Is Stored
On the blockchain, the following data may be stored and become public and effectively permanent:
- addresses of externally owned accounts;
- transactions made; and
- token balances.
On our servers, we may store:
- addresses of externally owned accounts;
- transactions made;
- log data and IP address; and
- transaction id / hash.
How We Use Information
- Provide and improve the Services. To deliver, personalize, develop, test, troubleshoot, and improve our features and content.
- Safety, integrity, and security. To verify activity, combat harmful conduct, detect and prevent abuse, and maintain the integrity and security of the Services.
- Communicate with you. To respond to you when you contact us, communicate about the Services, and let you know about our policies and terms.
Because recognition of the “Do Not Track” HTTP header is not standardized, the Services do not respond to it for tracking purposes.
Third-Party Data Collection
Third parties may collect or receive certain information about you and/or your use of the Services to provide functionality, infrastructure, or analytics. These third parties may include wallet and authentication providers, fiat on-ramp providers, cloud hosting and content-delivery providers, and analytics, monitoring, and error-reporting providers. Each third party processes data under its own terms and privacy policy.
Retention
We may keep the information we gather about you for as long as necessary to provide the Services and for legitimate business or legal purposes. To request that information collected about you be deleted, please contact us at the email below. A valid request must include sufficient information to identify your personal data. Note that we cannot delete information stored on public blockchains.
Sharing
- We may transfer your personal data to a third party as a result of a business combination, merger, asset sale, reorganization, or similar transaction.
- We may share your information with third parties where we have a good-faith belief that doing so is reasonably necessary to detect or protect against fraud or security issues, enforce our terms, comply with an enforceable government or legal request, or protect our legal rights or safety.
- To operate the Services, we share information as needed with our service providers, including hosting, analytics, and on-ramp providers, only to the extent required to provide the Services.
- The Services may contain links to third-party websites that are not under our control. We are not responsible for those websites; any information you provide to them is subject to their terms and privacy policies.
Opt-Out
If you wish to stop receiving marketing or promotional communications, follow the opt-out instructions (such as “Unsubscribe”) in those communications, or contact us at kvn9857@pm.me. Despite your preferences, we may send you service-related communications, including notices of updates to our terms or this policy.
Security
We have put in place appropriate security measures to help prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. We limit access to your personal data to those who have a business need to know, and they are subject to a duty of confidentiality. We have procedures to deal with any suspected personal-data breach and will notify you and any applicable regulator where we are legally required to do so.
